The value of estate planning and having a valid will were in the spotlight at Gunnedah Evening VIEW Club’s May dinner meeting where principal solicitor and accredited mediator, Stacey McAllan, and estate lawyer Allison Clark were guest speakers.

Stacey McAllan Legal was formed 15 years ago when Stacey took over Walker Beer & Associates, with Alan Beer staying on for some time to ensure a smooth transition. During this period the firm expanded into Family Law and dispute resolution and Stacey says it is a “privilege to help people who are vulnerable in these situations”.

Alison specialises in estate planning and administration, which has become her passion.

“Estate planning can be stressful but it sets out your wishes and can be changed as many times as you like,” she said.

Both speakers emphasised the importance of having a valid will, covering Enduring Power of Attorney and Enduring Guardianship. A will codicil can be added and updated at any time and will become valid after death.

“Enduring Power of Attorney and Enduring Guardianship become valid and take effect during your lifetime, covering assistance with financial matters and health, wellbeing and lifestyle,” Stacey said.

“That’s why it is so important that you have a well drafted will that outlines your wishes during your lifetime and after your death.”

If a will is contested, the court will in the first instance refer the matter to mediation.

“Approximately 70 per cent of disputes in NSW are resolved through mediation,” Stacey said.

“This can change the distribution to beneficiaries from that which is written in the will.”

The speakers also emphasised the importance of the “grandchild clause” in the case of a beneficiary dying before the parent. This simplifies a person’s wishes to have the beneficiary’s estate transferred to any grandchildren.

The topic of Advanced Health Care Directive was also covered, addressing a person’s wishes regarding medical treatment if unable to make decisions themselves. It also addresses a person’s clear wishes for end-of -life care.

The discussion closed with questions from members and the assurance that it is never too early to make a will.

“Everyone 18 years and over should have a well drafted will,” Stacey said.

Members have received invitations to the zone VIEW Gala Day in Tamworth on June 21 and Coonabarabran VIEW Club’s birthday on June 5.
